This is meant to be read by humans, not lawyers. The short version below is the part you actually need to understand. The formal terms after it are what you agree to when you use the pack.
The short version
You're setting up a personal AI agent on your own computer. It's useful. It is not magic, not a person, and not a professional. A few things to know before you lean on it.
Your agent will make mistakes
It can be confidently wrong. It can make up facts, dates, names, and numbers. It can misread a document or misremember something you told it. This is true of every AI agent that exists today, including this one. Treat it like the smartest collaborator you've ever had who has never left the room and sometimes makes things up.
Keep backups of anything important
Your agent works with real files on your own computer. Software can lose data: a bad edit, a crash, a mistaken delete, a sync conflict. Anything you would be upset to lose, back it up yourself somewhere outside the agent's folder. Divergent Systems does not store your data and cannot recover it for you.
Review everything before you act on it
Especially anything that matters: facts, money, dates, names, summaries of documents, messages it drafts, and any action it's about to take in the real world. Read it first. Verify the things that count. The agent is a starting point, not a final answer.
It is not a substitute for a professional
When the question is medical, legal, financial, or therapeutic, see a licensed human. The agent can help you think and prepare. It cannot give you advice you should rely on for high-stakes decisions.
You run it; you're responsible for it
This is local-first software. It runs on your computer, under your AI subscription, on your files. You decide what it does and what it touches. Divergent Systems does not operate it, monitor it, or have access to your workspace.
You agree to the terms below
By installing, acknowledging this disclaimer during setup, or using the pack, you accept the full terms below — including that the pack is provided "as is," that our liability is limited, and that you agree to indemnify Butler Software Labs LLC.
If you don't agree with these terms, don't use the pack — request a refund instead.
Formal terms
These terms govern your purchase and use of the Divergent Starter Pack (the "Pack"), a downloadable software template and skill suite sold by Butler Software Labs LLC, a California limited liability company, operating the Divergent Systems product ("we," "us," "DS"). By purchasing the Pack, attaching it to an AI harness, acknowledging this disclaimer during setup, or otherwise using the Pack, you ("you") agree to these terms.
1. What the Pack is
The Pack is a set of plain files: agent template files, onboarding files, and skills, delivered as a one-time download. It is designed to run inside a third-party AI coding harness (such as Claude Code or Codex) on your own computer, using your own subscription to a third-party AI provider (such as Anthropic or OpenAI). The Pack is "local-first": it runs on your machine, on your files, and we do not host it, operate it, or have access to your workspace or data.
2. Third-party software and providers
The Pack depends on software and services we do not control, including the AI harness, the AI model provider, and your operating system. We do not warrant their availability, behavior, pricing, or output. Your use of those services is governed by their own terms, and you are responsible for any fees they charge (typically a separate AI subscription, around $20/month, paid directly to the provider). We do not mark up or resell AI usage.
3. AI outputs — no reliance without verification
The Pack runs an AI agent. AI agents produce output that can be inaccurate, incomplete, outdated, biased, or entirely fabricated ("hallucinated"). The agent can also take actions on your computer at your direction. You are responsible for reviewing and verifying the agent's output and actions before relying on or acting on them, especially anything involving money, legal or medical matters, personal safety, communications sent on your behalf, or changes to your files. The agent is not a substitute for a licensed professional. For medical, legal, financial, or therapeutic decisions, consult a qualified human.
4. Your data and backups
The Pack reads and writes files on your own computer, including a memory store and knowledge base. You are solely responsible for backing up your data. We do not store, host, transmit, or have access to your workspace, and we cannot recover data that is lost, corrupted, or deleted, whether by the agent, the harness, the operating system, a sync tool, or any other cause. Back up anything important to a location outside the Pack folder.
5. Acceptable use
You agree not to use the Pack, or direct the agent, to do anything illegal, to harm others, to violate the terms of the AI provider or harness, or to generate content that violates applicable law. You are responsible for how you use the agent and for the consequences of the actions you direct it to take.
6. Warranty disclaimer
The Pack is provided "as is" and "as available," without warranties of any kind, express or implied, to the maximum extent permitted by law. We do not warrant that the Pack will be uninterrupted or error-free, that it will meet your requirements, that it is compatible with any particular system or future version of any third-party software, or that the agent's outputs will be accurate, appropriate, safe, or fit for any particular purpose. Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, the exclusions apply to the fullest extent permitted.
7. Limitation of liability
To the maximum extent permitted by law, our total liability to you for any and all claims arising out of or related to the Pack is limited to the amount you actually paid us for the Pack. Neither we nor Butler Software Labs LLC is liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including lost data, lost profits, lost time, or business interruption, even if advised of the possibility. Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the fullest extent permitted.
8. Indemnification
You agree to indemnify, defend, and hold harmless Butler Software Labs LLC and Divergent Systems, and their members, officers, and agents, from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Pack; (b) actions you directed the agent to take; (c) your violation of these terms; (d) your violation of any third-party terms (including the AI harness or provider); or (e) content you created, processed, or distributed using the Pack.
9. Refunds
If the Pack is not a fit, you may request a refund through the platform you purchased it from (e.g. Gumroad), subject to that platform's refund process. Requesting and receiving a refund ends your license to use the Pack.
10. License
On purchase, you receive a non-exclusive, non-transferable license to use the Pack for your own personal use. You may modify the files for your own use. You may not resell, redistribute, or republish the Pack or substantial portions of it as your own product.
11. Governing law
These terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Any dispute will be brought in the state or federal courts located in Los Angeles County, California.
12. Changes
We may update these terms for future versions of the Pack. The version you agreed to at purchase governs your copy. The current version is identified at the top of this document.
